Intellectual property of software

The user must respect third party programs made available to him by Hergon Metropolitan SLU, even if they are free and/or publicly available.

The user does not acquire any right or license for the contracted service, to the software necessary for the provision of the service, nor to the technical information for monitoring the service, except for the rights and licenses necessary for the performance of the contracted services and only for the duration of the service.

For any action that exceeds the fulfillment of the contract, the user will need written authorization from Hergon Metropolitan SLU.
The user is prohibited from accessing, modifying, viewing the configuration, structure and files of the servers owned by Hergon Metropolitan SLU, assuming civil and criminal liability deriving from any incident that may occur in the servers and security systems as a direct result of negligent or malicious action on their part.

Intellectual property of hosted content

It is forbidden the use of the services provided by Hergon Metropolitan SLU contrary to intellectual property law and in particular:
1. The use that is contrary to Spanish law or that infringes the rights of third parties.
2. The posting or transmitting any content that Hergon Metropolitan SLU deems to be violent, obscene, abusive, illegal, racial, xenophobic or defamatory.

5. The use of the domain's mail server and email addresses for sending bulk mail.

The user is fully responsible for the content of its website; the information transmitted and stored, hypertext links, the claims of third parties and legal actions with regard to intellectual property, the rights of third parties and the protection of underage.

The user is responsible for the laws and regulations in force and the rules that have to do with the operation of the online service, e-commerce, copyright, maintenance of public order, as well as universal principles of Internet use.

The User shall indemnify Hergon Metropolitan SLU for the costs incurred by the imputation of Hergon Metropolitan SLU in any cause for which the user is responsible, including legal fees and expenses, even in the case of a non-final court decision.

Protection of hosted information

Hergon Metropolitan SLU makes backups of the contents hosted on its servers, however it is not responsible for the loss or accidental deletion of data by users. Likewise, it does not guarantee the complete restoration of the data deleted by the users, since the aforementioned data could have been deleted and/or modified during the time elapsed since the last backup.

The services offered, with the exception of specific backup services, do not include the replacement of the contents preserved in the backup files made by Hergon Metropolitan SLU when this loss is attributable to the user; in this case, a fee will be determined according to the complexity and volume of the recovery, always subject to the user's prior consent.

The replacement of deleted data is only included in the price of the service when the loss of content is due to causes attributable to Hergon Metropolitan SLU.

Commercial communications

Under the LSSI. Hergon Metropolitan SLU will not send advertising or promotional communications by e-mail or other equivalent means of electronic communication that have not been previously requested or expressly authorized by the recipients thereof.

In the case of users with whom there is a prior contractual relationship, Hergon Metropolitan SLU is authorized to send commercial communications regarding products or services of Hergon Metropolitan SLU that are similar to those initially contracted with the client.
